2 An act relating to cloning; prohibiting cloning
3 of any human being in the state; providing a
4 penalty; providing definitions; providing for
5 genetic research, diagnosis, and therapeutic
6 processes; establishing a genetic information
7 resource committee; providing duties and
8 membership; requiring a report; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. (1) It shall be unlawful in this state to
14 clone or attempt to clone any human being. A person who
15 clones or attempts to clone any human being commits a felony
16 of the first degree, punishable as provided in s. 775.082, s.
17 775.083, or s. 775.084, Florida Statutes.
18 (2)(a) "Cloning a human being" means creating a new
19 individual by using the complete nuclear genetic material of
20 an existing human being to create a second genetic duplicate
21 of that human being.
22 (b) "Cloning human DNA" means replication or copying
23 of a portion of a human being's genes or DNA for research,
24 diagnostic, or therapeutic purposes.
25 (c) Cloning a human being does not include cloning
26 portions of human DNA for the purpose of molecular genetic
27 research, diagnosis, or therapeutic processes. This act is
28 not intended to prohibit DNA research into any inherited
29 disorder, of which more than 3,000 are now known, including
30 cystic fibrosis, certain cases of breast cancer, and muscular
31 dystrophy.

1 Section 2. A genetic information resource committee is
2 hereby established to advise the Florida Legislature on
3 matters concerning human genetics and related research
4 developments. The committee shall include three members who
5 are recognized experts in human or animal genetics from the
6 three Florida universities with allopathic medical schools.
7 The members shall be appointed for 3-year terms by the Vice
8 President for Medical Affairs at each of the three
9 universities, in consultation with any interested medical
10 association. In addition, the committee shall include two
11 ethicists who are recognized experts in medical ethics. On or
12 before January 1, 1999, the committee shall submit a report to
13 the Legislature.
14 Section 3. This act shall take effect October 1, 1997.
