17  and insert in lieu thereof:

18         (4)  In any case in which the biological father cannot

19  be located through the efforts listed in this section, notice

20  by publication must be placed in a newspaper of general paid

21  circulation and of general interest and readership, as defined

22  in chapter 50, in the county of the biological father's last

23  known legal residence. This notice must state that a petition

24  for adoption has been filed and provide the case number and

25  the address and telephone number of the clerk of the court

26  where the petition is pending. The notice must clearly state

27  "FAILURE TO RESPOND IN A TIMELY FASHION TO THIS NOTICE SHALL

28  CONSTITUTE A CONSENT TO THE ADOPTION." The notice must be

29  placed no less than 3 days after the petition for adoption is

30  filed and must run two times a week for 2 consecutive weeks.

 3  adoption may provide consent to the adoption.  In such case,
