1 A bill to be entitled
2 An act relating to traumatic brain injury;
3 creating s. 402.09, F.S.; requiring the
4 Department of Children and Family Services to
5 provide services, in certain circumstances, to
6 individuals who have sustained traumatic brain
7 injury; providing for rules; providing an
8 effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 402.09, Florida Statutes, is
13 created to read:
14 402.09 Traumatic brain injury.--
15 (1) The Department of Children and Family Services
16 shall, contingent upon specific appropriations, establish a
17 program of long-term supports and services for individuals who
18 have sustained traumatic brain injuries and whose needs cannot
19 be met through other programs related to brain injury which
20 are located within the Department of Health, the Department of
21 Labor and Employment Security, or the Department of Children
22 and Family Services, or whose needs cannot be met through any
23 other programs for which they may be eligible. The
24 determination-of-eligibility process for this program must
25 include a process for ensuring that the individual is
26 ineligible for other programs or has needs that cannot be met
27 through other programs of the department or other agencies for
28 which he or she is eligible. This program is to be the program
29 of last resort for individuals who have sustained traumatic
30 brain injuries. Supports and services may be purchased by
31 department staff. This program is intended to prevent

1 inappropriate residential and institutional placements and
2 must be designed to enhance or maximize the individual's
3 independence.
4 (2) The department of Children and Family Services
5 shall adopt rules for implementing and administering the
6 program and shall establish the eligibility criteria for
7 individuals applying for and receiving services from the
8 program.
9 Section 2. This act shall take effect upon becoming a
10 law.
