11  The Committee on Ways and Means recommended the following

12  amendment:

14         Senate Amendment (with title amendment) 

15         Delete everything after the enacting clause

16

17  and insert:

18         Section 1.  (1)  The Tobacco Settlement Trust Fund is

19  created to accept deposit of all funds received by the state

20  as a result of the settlement of its lawsuit against the

21  tobacco industry.

22         (2)  All funds transferred to and retained in the trust

23  fund shall be invested pursuant to section 18.125, Florida

24  Statutes. All interest accruing to the trust fund shall be

25  deposited in the trust fund and shall be subject to

26  appropriation by the Legislature.

27         (3)  Pursuant to the provisions of Section 19(f)(2),

28  Article III of the State Constitution, the Tobacco Settlement

29  Trust Fund shall, unless terminated sooner, be terminated on

30  July 1, 2002. Prior to its scheduled termination, the trust

31  fund shall be reviewed as provided in section 215.3206(1) and

18         investment of funds; providing for review and

19         termination of the trust fund; providing an

20         effective date.
