  1                      A bill to be entitled

  2         An act relating to domestic violence; amending

  3         s. 741.28, F.S.; providing that domestic

  4         violence does not include disciplinary action

  5         against a child unless the action is

  6         excessively harsh or inappropriate as specified

  7         in s. 415.503(9)(a)4., F.S; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (1) of section 741.28, Florida

13  Statutes, is amended to read:

14         741.28  Domestic violence; definitions.--As used in ss.

15  741.28-741.31:

16         (1)  "Domestic violence" means any assault, aggravated

17  assault, battery, aggravated battery, sexual assault, sexual

18  battery, stalking, aggravated stalking, kidnapping, false

19  imprisonment, or any criminal offense resulting in physical

20  injury or death of one family or household member by another

21  who is or was residing in the same single dwelling unit.

22  Domestic violence does not include disciplinary action or

23  corporal discipline to a child unless such action is

24  excessively harsh or inappropriate and results in harm to the

25  child, whether physical, mental, or emotional, as specified in

26  s. 415.503(9)(a)4.

27         Section 2.  This act shall take effect July 1, 1998.
