Florida Senate - 1998 SB 132 By Senator Crist 20-91-98 1 A bill to be entitled 2 An act relating to elections; amending s. 3 106.17, F.S.; prohibiting state agencies and 4 certain other governmental entities from 5 soliciting pledges or authorizing or conducting 6 polls or surveys relating to candidacies for 7 public office; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Section 106.17, Florida Statutes, is 12 amended to read: 13 106.17 Polls and surveys relating to candidacies; 14 prohibitions.-- 15 (1) Any candidate, political committee, or state or 16 county executive committee of a political party may authorize 17 or conduct a political poll, survey, index, or measurement of 18 any kind relating to candidacy for public office so long as 19 the candidate, political committee, or political party 20 maintains complete jurisdiction over the poll in all its 21 aspects. 22 (2) A state agency may not solicit any pledge or 23 authorize or conduct any political poll, survey, index, or 24 measurement of any kind for the purpose of evaluating or 25 rating any candidate for public office. As used in this 26 subsection, the term "state agency" means any official, 27 officer, commission, authority, council, committee, 28 department, division, bureau, board, section, or other unit or 29 entity of the executive branch of state government or adjunct 30 or advisory thereto or any other unit of government which 31 receives the majority of its funding from the state. 1 CODING: Words stricken are deletions; words underlined are additions.
