Florida House of Representatives - 1997 HB 133 By Representative Lacasa 1 A bill to be entitled 2 An act relating to state uniform traffic 3 control; amending ss. 316.075 and 316.192, 4 F.S.; revising language with respect to traffic 5 control signal devices; providing that reckless 6 driving shall include violations for running a 7 red light; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Paragraph (a) of subsection (2) of section 12 316.075, Florida Statutes, is amended to read: 13 316.075 Traffic control signal devices.--Except for 14 automatic warning signal lights installed or to be installed 15 at railroad crossings, whenever traffic, including municipal 16 traffic, is controlled by traffic control signals exhibiting 17 different colored lights, or colored lighted arrows, 18 successively one at a time or in combination, only the colors 19 green, red and yellow shall be used, except for special 20 pedestrian signals carrying a word legend, and the lights 21 shall indicate and apply to drivers of vehicles and 22 pedestrians as follows: 23 (2) STEADY YELLOW INDICATION.-- 24 (a) Vehicular traffic facing a steady yellow signal is 25 thereby warned that the related green movement is being 26 terminated, or that a red indication will be exhibited 27 immediately thereafter when vehicular traffic shall not enter 28 the intersection, and is thereby advised that there may be 29 insufficient time to cross the intersection safely and that 30 other vehicles may be entering the intersection as permitted 31 by their traffic control signal device. 1 CODING: Words stricken are deletions; words underlined are additions. Subsection (2) of section 316.192, Florida 2 Statutes, is amended to read: 3 316.192 Reckless driving.-- 4 (2) Any person convicted of reckless driving shall be 5 punished: 6 (a) Upon a first conviction, by imprisonment for a 7 period of not more than 90 days or by fine of not less than 8 $25 nor more than $500, or by both such fine and imprisonment. 9 (b) On a second or subsequent conviction, by 10 imprisonment for not more than 6 months or by a fine of not 11 less than $50 nor more than $1,000, or by both such fine and 12 imprisonment. In addition, if the person's reckless driving 13 causes or results in the death of another, the person may 14 serve 120 community hours as provided in s. 316.027(4). 15 16 Any person who violates s. 316.075(3)(a) shall be guilty of 17 reckless driving. 18 Section 3.
