2 An act relating to rulemaking authority with
3 respect to law enforcement (RAB); amending s.
4 112.193, F.S.; authorizing public employers to
5 adopt rules establishing eligibility
6 requirements and application procedures and
7 other matters relating to service awards;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:
11
12 Section 1. Section 112.193, Florida Statutes, is
13 amended to read:
14 112.193 Law enforcement, correctional, and
15 correctional probation officers' commemorative service
16 awards.--
17 (1) For the purposes of this section, the term:
18 (a) "Employer" means a state board, commission,
19 department, division, bureau, or agency or a county or
20 municipality.
21 (b) "Law enforcement, correctional, or correctional
22 probation officer" means any full-time, part-time, or
23 auxiliary officer as defined in s. 943.10(14).
24 (2) Each employer that employs or appoints law
25 enforcement, correctional, or correctional probation officers
26 may present to each such employee who retires under any
27 provision of a state or municipal retirement system, including
28 medical disability retirement, or who is eligible to retire
29 under any such provision but, instead, resigns from one
30 employer to accept an elected public office, one complete
31 uniform including the badge worn by that officer, the

1 officer's service handgun, if one was issued as part of the
2 officer's equipment, and an identification card clearly marked
3 "RETIRED."
4 (3) Upon the death of a law enforcement, correctional,
5 or correctional probation officer, the employer may present to
6 the spouse or other beneficiary of the officer, upon request,
7 one complete uniform, including the badge worn by the officer.
8 However, if a law enforcement, correctional, or correctional
9 probation officer is killed in the line of duty, the employer
10 may present, upon request, to the spouse or other beneficiary
11 of the officer, the officer's service-issued handgun, if one
12 was issued as part of the officer's equipment. If the
13 employer is not in possession of the service-issued handgun,
14 the employer may, within its discretion, and upon written
15 request of the spouse or other beneficiary, present a similar
16 handgun. The provisions of this section shall also apply in
17 that instance to a law enforcement or correctional officer who
18 died before May 1, 1993. In addition, the officer's service
19 handgun may be presented by the employer for any such officer
20 who was killed in the line of duty prior to this act becoming
21 a law.
22 (4) Each uniform, badge, service handgun, and
23 identification card presented under this section is to
24 commemorate prior service and must be used only in such manner
25 as the employer prescribes by rule. Employers may also adopt
26 rules establishing eligibility requirements, application
27 procedures, and other matters necessary to administer this
28 section. The provisions of this section shall also apply in
29 that instance to a law enforcement officer who died before May
30 1, 1993.

1 Section 2. This act shall take effect upon becoming a
2 law.
