2 An act relating to trust funds; creating the
3 County Article V Trust Fund to be administered
4 by the Supreme Court; providing for future
5 review and termination or re-creation of the
6 fund; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. The County Article V Trust Fund is hereby
11 created, to be administered by the Supreme Court. Funds shall
12 be credited to the trust fund as provided in HB or
13 similar legislation, for the purposes set forth therein.
14 Section 2. (1) Pursuant to the provisions of Section
15 19(f)(2), Article III of the State Constitution, the County
16 Article V Trust Fund shall, unless terminated sooner, be
17 terminated on June 30, 2001.
18 (2) Prior to the regular legislative session
19 immediately preceding the date on which the trust fund is
20 scheduled to be terminated, the Supreme Court shall recommend
21 to the President of the Senate and the Speaker of the House of
22 Representatives whether the trust fund should be allowed to
23 terminate or should be re-created. These recommendations shall
24 be based on a review of the purpose and use of the trust fund
25 and a determination of whether the trust fund will continue to
26 be necessary. A recommendation to re-create the trust fund may
27 include suggested modifications to the purposes, sources of
28 receipts, and allowable expenditures for the trust fund. The
29 Supreme Court's recommendation shall be made as a part of its
30 legislative budget request to the Legislature under section
31 216.023, Florida Statutes.

1 (3) If the trust fund is terminated, the Supreme Court
2 must pay any outstanding debts or obligations of the trust
3 fund as soon as practicable and the Comptroller must close out
4 and remove the trust fund from the various state accounting
5 systems, using generally accepted accounting practices
6 concerning warrants outstanding, assets, and liabilities.
7 Section 3. This act shall take effect July 1, 1997.

10 LEGISLATIVE SUMMARY
11 Creates the County Article V Trust Fund to be
administered by the Supreme Court. Provides for future
12 review and termination or re-creation of the fund. If
the fund is terminated, the Supreme Court must pay any
13 outstanding debts. The Comptroller must remove the trust
fund from the various state accounting systems.
