  1                      A bill to be entitled

  2         An act relating to workers compensation;

  3         amending s. 440.49, F.S.; authorizing the

  4         Special Disability Trust Fund to make an offer,

  5         deny a claim, or request further information;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Paragraph (b) of subsection (7) of section

11  440.49, Florida Statutes, is amended to read:

12         440.49  Limitation of liability for subsequent injury

13  through Special Disability Trust Fund.--

14         (7)  REIMBURSEMENT OF EMPLOYER.--

15         (b)  For notice of claims on the Special Disability

16  Trust Fund filed on or after July 1, 1978, the Special

17  Disability Trust Fund shall, within 120 days after receipt of

18  notice that a carrier has paid, been required to pay, or

19  accepted liability for excess compensation, serve notice of

20  the acceptance of the claim for reimbursement. The Special

21  Disability Trust Fund may make an offer, deny the claim, or

22  request further information.

23         Section 2.  This act shall take effect upon becoming a

24  law.
