1 A bill to be entitled
2 An act relating to Volusia County; amending ch.
3 70-966, Laws of Florida, which establishes the
4 charter government of the county; establishing
5 nonpartisan election of school board members;
6 ratifying the referendum election; providing
7 for the repeal of laws in conflict herewith;
8 providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Chapter 70-966, Laws of Florida, as amended
13 by section 2 of chapter 70-967, Laws of Florida, is amended to
14 read:
15 Article IX. ELECTIONS.
16 Section 904. Nonpartisan Elections. Elections for all
17 offices shall be on a nonpartisan basis. No candidates shall
18 be required to pay any party assessment or be required to
19 state the party of which they are a member or the manner in
20 which they voted or will vote in any election. School Board
21 members elected after January 1, 1995, shall be elected on a
22 nonpartisan basis in the manner provided in section 901.1(3)
23 of the Charter. All candidates names shall be placed on the
24 ballot without reference to political party affiliation.
25 Section 2. The referendum election held in Volusia
26 County on November 8, 1994, approving the amendment specified
27 in section 1, and all acts and proceedings held in connection
28 with said referendum, are hereby ratified and declared legal
29 and valid.
30 Section 3. Nothing in this act shall be otherwise
31 construed to add to or detract from the power of the people of

1 Volusia County to amend their charter in accordance with the
2 Charter and the provisions of s. 1(c), Art. VIII of the State
3 Constitution.
4 Section 4. All laws or portions of laws in conflict
5 herewith are hereby repealed to the extent of such conflict.
6 Section 5. This act shall take effect upon becoming a
7 law.
