  1                      A bill to be entitled

  2         An act relating to stormwater management system

  3         permitting and review; creating s. 373.4132,

  4         F.S.; providing conditions under which a county

  5         may remove itself from the jurisdiction of the

  6         water management district with respect to

  7         permitting and review of such systems;

  8         providing a limitation on fees; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Section 373.4132, Florida Statutes, is

14  created to read:

15         373.4132  Stormwater management system permitting and

16  review; conditions under which a county may remove itself from

17  water management district jurisdiction.--The governing board

18  of a county may certify that the county, either through its

19  internal resources or through private entities with which the

20  county contracts, is qualified to review and certify

21  stormwater management systems consistent with control and

22  retention onsite, or offsite if a common stormwater retention

23  strategy is utilized, of the 25-year flood event.  If the

24  governing board so certifies, the county may elect to remove

25  itself from the jurisdiction of the water management district

26  or districts in which the county lies with respect to any

27  permitting and review of stormwater management systems

28  required under this part.  No fee imposed by a county for the

29  permitting or review of a stormwater management system shall

30  exceed the comparable fee scheduled by the water management

  1  district or districts which would otherwise have jurisdiction

  2  on March 1, 1997.

  3         Section 2.  This act shall take effect July 1, 1997.

      Provides that a county that certifies that it is
  8    qualified to review and certify stormwater management
      systems may elect to remove itself from the jurisdiction
  9    of the water management district with respect to
      permitting and review of such systems.  Limits the fees
10    such counties may charge for such permitting and review.
