1 A bill to be entitled
2 An act relating to legislative employees;
3 amending s. 121.055, F.S.; authorizing the
4 President of the Senate and the Speaker of the
5 House of Representatives to designate
6 additional employees of their respective house
7 who may be required to participate in the
8 Senior Management Service Class of the Florida
9 Retirement System; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Paragraph (c) of subsection (1) of section
14 121.055, Florida Statutes, is amended to read:
15 121.055 Senior Management Service Class.--There is
16 hereby established a separate class of membership within the
17 Florida Retirement System to be known as the "Senior
18 Management Service Class," which shall become effective
19 February 1, 1987.

21 (c)1.a. Effective January 1, 1990, participation in
22 the Senior Management Service Class shall be compulsory for up
23 to 75 nonelective positions at the level of committee staff
24 director or higher or equivalent managerial or policymaking
25 positions within the House of Representatives, as selected by
26 the Speaker of the House of Representatives, up to 50
27 nonelective positions at the level of committee staff director
28 or higher or equivalent managerial or policymaking positions
29 within the Senate, as selected by the President of the Senate,
30 all staff directors of Joint Committees of the Legislature,
31 the Auditor General and up to 9 managerial or policymaking

1 positions within his or her office as selected by the Auditor
2 General, and the executive director of the Commission on
3 Ethics.
4 b. Effective January 1, 1999, participation in the
5 Senior Management Service Class shall be compulsory for up to
6 175 nonelective positions within the Senate which are selected
7 by the President of the Senate and for which participation is
8 not compulsory pursuant to sub-subparagraph a. and up to 275
9 nonelective positions within the House of Representatives
10 which are selected by the Speaker of the House of
11 Representatives and for which participation is not compulsory
12 pursuant to sub-subparagraph a.
13 2. Participation in this class shall be compulsory,
14 except as provided in subparagraph 3., for any legislative
15 employee who holds a position designated for coverage in the
16 Senior Management Service Class, and such participation shall
17 continue until the employee terminates employment in a covered
18 position.
19 3. In lieu of participation in the Senior Management
20 Service Class, in the discretion of the Joint Legislative
21 Management Committee, such members may participate in the
22 Senior Management Service Optional Annuity Program as
23 established in subsection (6).
24 Section 2. This act shall take effect January 1, 1999.

27 SENATE SUMMARY
28 Authorizes the President of the Senate to designate
additional employees of the Senate, and the Speaker of
29 the House of Representatives to designate additional
employees of the House of Representatives, for whom
30 membership in the Senior Management Service Class of the
Florida Retirement System will become compulsory.
