  2         An act relating to the Bayshore Gardens Park

  3         and Recreation District; amending chapter

  4         79-509, Laws of Florida; increasing the minimum

  5         cost price or consideration of contracts

  6         involving the acquisition of real or tangible

  7         personal property which would require a

  8         two-thirds vote of district trustees and a

  9         referendum election; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Section 24 of chapter 79-509, Laws of

15  Florida, is amended to read:

16         Section 24.  (a)  Notwithstanding any provisions to the

17  contrary (as may now appear in Sections 8, 13 or 15), the

18  trustees shall not enter into any future contracts involving

19  the purchase, lease, conveyance or other manner of acquisition

20  of real or tangible personal property in any instance when the

21  cost price or consideration therefor exceeds Twenty-five

22  Thousand ($25,000) Fifteen Thousand ($15,000.00) Dollars,

23  including all obligations, proposed to be assumed in

24  connection with such acquisition, unless:

25         (1)  The trustees by two-thirds vote have approved the

26  terms and conditions of such acquisition by written

27  resolution.

28         (2)  Within not less than thirty (30) nor more than

29  sixty (60) days of the date of the resolution, the trustees

30  certify the resolution to the supervisor of elections of

31  Manatee County for a referendum election; and,

  1         (3)  A majority of qualified electors approve the

  2  resolution by referendum election.

  3         (b)  The qualifications of voters, notice and procedure

  4  for this referendum shall be the same as set forth herein for

  5  the election of trustees and for special referendum elections.

  6         Section 2.  This act shall take effect upon becoming a

  7  law.
