1 A bill to be entitled
2 An act relating to dietetics and nutrition
3 practice; creating a Task Force on Exemptions
4 from Licensure under s. 468.505(1)(k), F.S.,
5 which exempts certain persons employed by a
6 hospital, nursing home, assisted living
7 facility, or continuing care facility;
8 providing for membership and meetings of the
9 task force, including place of meetings;
10 requiring a report to certain legislative
11 leaders; providing responsibilities of the task
12 force; providing for dissolution of the task
13 force; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:
16
17 Section 1. (1) There is created within the Department
18 of Health a Task Force on Exemptions from Licensure under s.
19 468.505(1)(k), Florida Statutes. The Department of Health
20 shall provide staff support for the task force. The task force
21 shall consist of not more than 11 members nominated by the
22 associations and entities named in this section and appointed
23 by the Secretary of Health. Members of the task force shall
24 not receive compensation, per diem, or reimbursement for
25 travel expenses for service on the task force. Participation
26 in the task force is optional and at the discretion of each
27 identified group or entity. If all identified groups and
28 entities participate, the task force shall include:
29 (a) One representative from each of the following
30 associations:
31 1. The Florida Dietetic Association.

1 2. The Florida Health Care Association.
2 3. The Florida Association of Homes for the Aging.
3 4. The Florida Assisted Living Association.
4 5. The Florida League of Health Systems.
5 6. The Association of Community Hospitals and Health
6 Systems of Florida, Inc.
7 7. The Florida Hospital Association.
8 (b) One representative from each of the following
9 entities:
10 1. The Department of Health.
11 2. The Dietetics and Nutrition Practice Council.
12 3. The Board of Medicine, which representative must be
13 a member of the board who is licensed under chapter 458,
14 Florida Statutes.
15 4. The Board of Osteopathic Medicine, which
16 representative must be a member of the board who is licensed
17 under chapter 459, Florida Statutes.
18 (2) The task force shall hold its first meeting no
19 later than August 1, 1997, and shall report its findings to
20 the President of the Senate, the Speaker of the House of
21 Representatives, and the chairs of the applicable legislative
22 committees of substance not later than December 31, 1997. All
23 task force meetings must be held in Tallahassee at the
24 Department of Health in order to minimize costs to the state.
25 (3) The task force shall be charged with the
26 responsibility to:
27 (a) Determine the number of licensed dietitians, the
28 number of registered dietitians, and the number of dietitians
29 who are neither licensed nor registered who are employed by or
30 under contract with a hospital licensed under chapter 395,
31 Florida Statutes, a nursing home or assisted living facility

1 licensed under part II or part III of chapter 400, Florida
2 Statutes, or a continuing care facility certified under
3 chapter 651, Florida Statutes; and
4 (b) Assess the need and make recommendations for
5 retaining the exemptions from licensure under s.
6 468.505(1)(k), Florida Statutes, in light of the legislative
7 purpose and intent of licensure as set forth in s. 468.502,
8 Florida Statutes, and review the quality of dietetic and
9 nutrition services provided in the settings set forth in s.
10 468.505(1)(k), Florida Statutes.
11 (4) The task force is dissolved effective January 1,
12 1998.
13 Section 2. This act shall take effect upon becoming a
14 law.
