  1                      A bill to be entitled

  2         An act relating to municipal special

  3         assessments; amending s. 170.201, F.S.;

  4         providing an exemption from any special

  5         assessment levied by a municipality to fund

  6         emergency medical services for property owned

  7         or occupied by a governmentally financed,

  8         insured, or subsidized housing facility used

  9         primarily for persons who are elderly or

10         disabled; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Subsection (2) of section 170.201, Florida

15  Statutes, is amended to read:

16         170.201  Special assessments.--

17         (2)  Property owned or occupied by a religious

18  institution and used as a place of worship or education; or by

19  a public or private elementary, middle, or high school; or by

20  a governmentally financed, insured, or subsidized housing

21  facility that is used primarily for persons who are elderly or

22  disabled shall be exempt from any special assessment levied by

23  a municipality to fund emergency medical services if the

24  municipality so desires.  As used in this subsection, the term

25  "religious institution" means any church, synagogue, or other

26  established physical place for worship at which nonprofit

27  religious services and activities are regularly conducted and

28  carried on and the term "governmentally financed, insured, or

29  subsidized housing facility" means a facility that is financed

30  by a mortgage loan made or insured by the United States

31  Department of Housing and Urban Development under s. 8, s.

  1  202, s. 221(d)(3) or (4), s. 232, or s. 236 of the National

  2  Housing Act and is owned or operated by an entity that

  3  qualifies as an exempt charitable organization under s.

  4  501(c)(3) of the Internal Revenue Code.

  5         Section 2.  This act applies to assessments levied on

  6  or after January 1, 1998.

  7         Section 3.  This act shall take effect upon becoming a

  8  law.
