13         Amendment to Senate Amendment (341634) (with title

14  amendment) 

15         On page 9, between lines 4 and 5,

17  insert:

18         Section 3.  Subsections (12), (13), (26), and (27) of

19  section 713.01, Florida Statutes, are amended to read:

20         713.01  Definitions.--As used in this part, the term:

21         (12)  "Improve" means build, erect, place, make, alter,

22  remove, repair, or demolish any improvement over, upon,

23  connected with, or beneath the surface of real property, or

24  excavate any land, or furnish materials for any of these

25  purposes, or perform any labor or services upon the

26  improvements, including the furnishing of carpet or rugs or

27  appliances that are permanently affixed to the real property

28  and final construction cleanup to prepare a structure for

29  occupancy; or perform any labor or services or furnish any

30  materials in grading, seeding, sodding, or planting for

31  landscaping purposes, including the furnishing of trees,

 1  shrubs, bushes, or plants that are planted on the real

 2  property, or in equipping any improvement with fixtures or

 3  permanent apparatus or provide any solid-waste collection or

 4  disposal on the site of the improvement.

 5         (13)  "Improvement" means any building, structure,

 6  construction, demolition, excavation, solid-waste removal,

 7  landscaping, or any part thereof existing, built, erected,

 8  placed, made, or done on land or other real property for its

 9  permanent benefit.

10         (26)  "Subcontractor" means a person other than a

11  materialman or laborer who enters into a contract with a

12  contractor for the performance of any part of such

13  contractor's contract, including the removal of solid waste

14  from the real property.

15         (27)  "Sub-subcontractor" means a person other than a

16  materialman or laborer who enters into a contract with a

17  subcontractor for the performance of any part of such

18  subcontractor's contract, including the removal of solid waste

19  from the real property.
