Florida House of Representatives - 1997 HB 1403 By Representative Tobin 1 A bill to be entitled 2 An act relating to construction liens; amending 3 s. 713.01, F.S.; redefining the terms 4 "improve," "improvement," "subcontractor," and 5 "sub-subcontractor" to include reference to 6 solid-waste removal; providing an effective 7 date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1. Subsections (12), (13), (26), and (27) of 12 section 713.01, Florida Statutes, are amended to read: 13 713.01 Definitions.--As used in this part, the term: 14 (12) "Improve" means build, erect, place, make, alter, 15 remove, repair, or demolish any improvement over, upon, 16 connected with, or beneath the surface of real property, or 17 excavate any land, or furnish materials for any of these 18 purposes, or perform any labor or services upon the 19 improvements, including the furnishing of carpet or rugs or 20 appliances that are permanently affixed to the real property 21 and final construction cleanup to prepare a structure for 22 occupancy; or perform any labor or services or furnish any 23 materials in grading, seeding, sodding, or planting for 24 landscaping purposes, including the furnishing of trees, 25 shrubs, bushes, or plants that are planted on the real 26 property, or in equipping any improvement with fixtures or 27 permanent apparatus or provide any solid-waste collection or 28 disposal on the site of the improvement. 29 (13) "Improvement" means any building, structure, 30 construction, demolition, excavation, solid-waste removal, 31 landscaping, or any part thereof existing, built, erected, 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1997 HB 1403 216-193-97 1 placed, made, or done on land or other real property for its 2 permanent benefit. 3 (26) "Subcontractor" means a person other than a 4 materialman or laborer who enters into a contract with a 5 contractor for the performance of any part of such 6 contractor's contract, including the removal of solid waste 7 from the real property. 8 (27) "Sub-subcontractor" means a person other than a 9 materialman or laborer who enters into a contract with a 10 subcontractor for the performance of any part of such 11 subcontractor's contract, including the removal of solid waste 12 from the real property. 13 Section 2.
