18 Section 3. Subsection (10) of section 440.185, Florida
19 Statutes, is created to read:
20 440.185 Notice of injury or death; reports; penalties
21 for violations.--
22 (10) Any information in a report of injury or illness
23 filed pursuant to this section that would identify an ill or
24 injured employee is confidential and exempt from the
25 provisions of s. 119.07(1) and s. 24(a), Art. I of the State
26 Constitution.

28 This subsection is subject to the Open Government Sunset
29 Review Act of 1995 in accordance with s. 119.15, and shall
30 stand repealed on October 2, 2003, unless reviewed and saved
31 from repeal through reenactment by the Legislature.

1 Section 4. The Legislature finds that it is a public
2 necessity that any information in a report of injury or
3 illness filed pursuant to s. 440.185, that would identify an
4 ill or injured employee, be held confidential and exempt
5 because such information is of a sensitive, personal nature.
6 Disclosure of such sensitive, personal information about an
7 employee is an invasion of that employee's privacy. Further,
8 the release of such information could lead to discrimination
9 against the employee by coworkers, potential employers, and
10 others. The harm caused to such an employee by the release of
11 this information outweighs any public benefit derived from its
12 release.
13 Section 5. Sections 1 and 2 of this act shall take
14 effect on the effective date of CS/CS/SB 1406, or similar
15 legislation, relating to the powers of the Division of
16 Workers' Compensation of the Department of Labor and
17 Employment Security, and Sections 3 and 4 of this act shall
18 take effect upon becoming law.
