17 Section 19. Section 332.003, Florida Statutes, is
18 amended to read:
19 332.003 Florida Airport Development and Assistance
20 Act; short title.--Sections 332.003-332.009 332.003-332.007
21 may be cited as the "Florida Airport Development and
22 Assistance Act."
23 Section 20. Subsections (1) and (5) of section
24 332.004, Florida Statutes, are amended to read:
25 332.004 Definitions of terms used in ss.
26 332.003-332.007.--As used in ss. 332.003-332.007, the term:
27 (1) "Airport" means any area of land or water, or any
28 manmade object or facility located therein, which is used, or
29 intended for public use, for the landing and takeoff of
30 aircraft, including reusable launch vehicles and other space
31 transportation systems, and any appurtenant areas which are

1 used, or intended for public use, for airport buildings or
2 other airport facilities or rights-of-way.
3 (5) "Airport or aviation discretionary capacity
4 improvement projects" or "discretionary capacity improvement
5 projects" means capacity improvements which are consistent, to
6 the maximum extent feasible, with the approved local
7 government comprehensive plans of the units of local
8 government in which the airport is located, and which enhance
9 intercontinental or space transportation capacity at airports
10 which:
11 (a) Are international airports with United States
12 Customs Service or a spaceport as defined in s. 331.303(19);
13 (b) Had one or more orbital flights or regularly
14 scheduled intercontinental flights during the previous
15 calendar year or have an agreement in writing for installation
16 of one or more orbital flights or regularly scheduled
17 intercontinental flights upon the commitment of funds for
18 stipulated airport capital improvements; and
19 (c) Have available or planned public ground
20 transportation between the airport and other major
21 transportation facilities.
22 Section 21. Paragraph (a) of subsection (7) of section
23 332.007, Florida Statutes, is amended to read:
24 332.007 Administration and financing of aviation and
25 airport programs and projects; state plan.--
26 (7) Subject to the availability of appropriated funds
27 in addition to aviation fuel tax revenues, the department may
28 participate in the capital cost of eligible public airport and
29 aviation discretionary capacity improvement projects. The
30 annual legislative budget request shall be based on the
31 funding required for discretionary capacity improvement

1 projects in the aviation and airport work program.
2 (a) The department shall provide priority funding in
3 support of:
4 1. Land acquisition which provides additional capacity
5 at the qualifying international airport or at that airport's
6 supplemental air carrier airport.
7 2. Runway and taxiway projects that add capacity or
8 are necessary to accommodate technological changes in the
9 aviation industry.
10 3. Airport access transportation projects that improve
11 direct airport access and are approved by the airport sponsor.
12 4. International terminal projects that increase
13 international gate capacity.
14 5. Commercial and dual-use space transportation
15 projects.
16 Section 22. Section 332.009, Florida Statutes, is
17 created to read:
18 332.009 Nothing in this chapter shall be construed to
19 authorize expenditure of aviation fuel tax revenues on space
20 transportation projects. Nothing in this chapter shall be
21 construed to limit the department's authority under s.
22 331.360.
