2 An act relating to license plates; amending ss.
3 320.08056, 320.08058, F.S.; creating a Choose
4 Life license plate; providing for the
5 distribution of annual use fees received from
6 the sale of such plates; providing a contingent
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (t) is added to subsection (4) of
12 section 320.08056, Florida Statutes, to read:
13 320.08056 Specialty license plates.--
14 (4) The following license plate annual use fees shall
15 be collected for the appropriate specialty license plates:
16 (t) Choose Life license plate, $20.
17 Section 2. Subsection (20) is added to section
18 320.08058, Florida Statutes, 1996 Supplement, to read:
19 320.08058 Specialty license plates.--
20 (20) CHOOSE LIFE LICENSE PLATES.--
21 (a) The department shall develop a Choose Life license
22 plate as provided in this section. The word "Florida" must
23 appear at the top of the plate, and the words "Choose Life"
24 must appear at the bottom of the plate.
25 (b) The annual use fees shall be distributed quarterly
26 to each county in the ratio that the annual use fees collected
27 by each county bears to the total fees collected for the
28 plates within the state. Each county shall distribute the
29 funds to nongovernmental agencies within the county, which
30 agencies' services are limited to counseling and meeting the
31 physical needs of pregnant women who are committed to placing

1 their children for adoption. Funds may not be distributed to
2 any agency that is involved or associated with abortion
3 activities, including counseling for or referrals to abortion
4 clinics, providing medical abortion-related procedures, or
5 pro-abortion advertising.
6 1. Agencies that receive the funds must use at least
7 70 percent of the funds to provide for the material needs of
8 pregnant women who are committed to placing their children for
9 adoption, including clothing, housing, medical care, food,
10 utilities, and transportation. Such funds may also be expended
11 on infants awaiting placement with adoptive parents.
12 2. The remaining funds may be used for adoption,
13 counseling, training, or advertising, but may not be used for
14 administrative expenses or capital expenditures.
15 3. Each agency that receives such funds must submit an
16 annual audit, prepared by a certified public accountant, to
17 the county. Any unused funds that exceed 10 percent of the
18 funds received by an agency during its fiscal year must be
19 returned to the county, which shall distribute them to other
20 qualified agencies.
21 Section 3. This act shall take effect July 1, 1998,
22 but it shall not take effect unless it is enacted by at least
23 a three-fifths vote of the membership of each house of the
24 Legislature.
