  1                      A bill to be entitled

  2         An act relating to rulemaking authority with

  3         respect to water treatment facilities (RAB);

  4         creating s. 403.88, F.S.; directing the

  5         Department of Environmental Protection to

  6         classify water and wastewater treatment

  7         facilities and staffing requirements by rule;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 403.88, Florida Statutes, is

13  created to read:

14         403.88  Classification of water and wastewater

15  treatment facilities and facility operators.--

16         (1)  The department shall classify water and wastewater

17  treatment plants by size, complexity, and level of treatment

18  necessary to render the wastewater or source water suitable

19  for its intended purpose in compliance with this chapter and

20  department rules.

21         (2)  The department shall establish the levels of

22  certification and the staffing requirements for water and

23  wastewater operators certified under ss. 403.865-403.876

24  necessary to carry out subsection (1).

25         (3)  The department shall adopt rules necessary to

26  carry out this section.

27         Section 2.  This act shall take effect upon becoming a

28  law.
