2 An act relating to felonies arising from the
3 use of destructive devices; amending s. 775.15,
4 F.S, relating to time limitations upon
5 prosecution; providing that prosecution for
6 such felonies arising from use of a destructive
7 device and resulting in personal injury may be
8 commenced at any time; providing an effective
9 date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (1) of section 775.15, Florida
14 Statutes, 1996 Supplement, is amended to read:
15 775.15 Time limitations.--
16 (1) A prosecution for a capital felony, a life felony,
17 or a felony that resulted in a death may be commenced at any
18 time. A prosecution for a felony that resulted in injury to
19 any person, when such felony arises from the use of a
20 "destructive device," as defined in s. 790.001, may be
21 commenced at any time. If the death penalty is held to be
22 unconstitutional by the Florida Supreme Court or the United
23 States Supreme Court, all crimes designated as capital
24 felonies shall be considered life felonies for the purposes of
25 this section, and prosecution for such crimes may be commenced
26 at any time.
27 Section 2. This act shall take effect upon becoming a
28 law and shall apply to pending cases the prosecution of which
29 has not been barred prior to that date.
