2 An act relating to the Florida Prepaid Tuition
3 Scholarship Program; reviving and readopting s.
4 240.552, F.S., which establishes the program;
5 providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Notwithstanding section 42 of chapter
10 91-201, Laws of Florida, section 240.552, Florida Statutes,
11 shall not stand repealed on October 1, 1997, as scheduled by
12 that law, but that section is revived and readopted to read:
13 240.552 Florida Prepaid Tuition Scholarship
14 Program.--The Florida Prepaid Tuition Scholarship Program is
15 hereby established with the intent to provide economically
16 disadvantaged youth with prepaid postsecondary tuition
17 scholarships. The direct-support organization established
18 pursuant to s. 240.551 shall administer the program with the
19 assistance and cooperation of the Department of Education to
20 achieve the following objectives:
21 (1) Provide an incentive for economically
22 disadvantaged youth to improve school attendance and academic
23 performance in order to graduate and pursue a postsecondary
24 education.
25 (2) Obtain the commitment and involvement of private
26 sector entities by virtue of funding matches with a ratio of
27 50 percent provided by the private sector and 50 percent
28 provided by the state.
29 (3) Purchase prepaid tuition scholarships for students
30 certified by the Department of Education to the direct-support

1 organization who meet minimum economic and school requirements
2 and remain drug free and crime free.
3 (a) For the purpose of this subsection, "drug free"
4 means not being convicted of, or adjudicated delinquent for,
5 any violation of chapter 893 after being designated a
6 recipient of a Florida prepaid tuition scholarship.
7 (b) For the purpose of this subsection, "crime free"
8 means not being convicted of, or adjudicated delinquent for,
9 any felony or first degree misdemeanor as defined in ss.
10 775.08 and 775.081 after being designated a recipient of a
11 Florida prepaid tuition scholarship.
12 Section 2. This act shall take effect October 1, 1997.
