2 An act relating to prison inmates; amending s.
3 440.15, F.S.; providing that workers'
4 compensation benefits for inmates are payable
5 to the state and prohibiting inmates from
6 receiving public assistance benefits; providing
7 an effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (9) of section 440.15, Florida
12 Statutes, 1996 Supplement, is amended to read:
13 440.15 Compensation for disability.--Compensation for
14 disability shall be paid to the employee, subject to the
15 limits provided in s. 440.12(2), as follows:
16 (9) EMPLOYEE BECOMES INMATE OF INSTITUTION.--In case
17 an employee becomes an inmate of a public institution, then no
18 compensation shall be payable to this state unless he has
19 dependent upon him for support a person or persons defined as
20 dependents elsewhere in this chapter, whose dependency shall
21 be determined as if the employee were deceased and to whom
22 compensation would be paid in case of death; and such
23 compensation as is due such employee shall be paid such
24 dependents during the time he remains such inmate.
25 Section 2. All public benefits provided to a person in
26 this state shall be terminated immediately when that person
27 becomes an inmate in any prison or other correctional
28 institution.
29 Section 3. This act shall take effect upon becoming a
30 law.
