1 A bill to be entitled
2 An act relating to prison inmates; amending s.
3 440.15, F.S.; providing that the state shall be
4 reimbursed for all medical treatment rendered
5 an inmate; providing that workers' compensation
6 benefits be paid in certain circumstances;
7 amending s. 414.095, F.S.; prohibiting
8 temporary cash assistance and services to an
9 inmate; amending s. 414.32, F.S.; prohibiting
10 food stamp issuance to an inmate; amending s.
11 409.903, F.S.; prohibiting the provision of
12 Medicaid services to an inmate; amending s.
13 409.904; F.S.; prohibiting optional payments
14 for medical assistance and related services to
15 an inmate; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Subsection (9) of section 440.15, Florida
20 Statutes, is amended to read:
21 440.15 Compensation for disability.--Compensation for
22 disability shall be paid to the employee, subject to the
23 limits provided in s. 440.12(2), as follows:
24 (9) EMPLOYEE BECOMES INMATE OF INSTITUTION.--In case
25 an employee becomes an inmate of a public institution, then no
26 compensation shall be payable unless she or he has dependent
27 upon her or him for support a person or persons defined as
28 dependents elsewhere in this chapter, whose dependency shall
29 be determined as if the employee were deceased and to whom
30 compensation would be paid in case of death; and such

1 compensation as is due such employee shall be paid such
2 dependents during the time she or he remains such inmate.
3 (a) The state shall be entitled to and shall seek
4 reimbursement, pursuant to the medical reimbursement schedule
5 for all medical treatment rendered an inmate related to his
6 on-the-job injury.
7 (b) This subsection shall not apply to workers'
8 compensation benefits required under s. 946.006(4).
9 Section 2. Paragraph (j) is added to subsection (15)
10 of section 414.095, Florida Statutes, to read:
11 414.095 Determining eligibility for the WAGES
12 Program.--
13 (15) PROHIBITIONS AND RESTRICTIONS.--
14 (j) All temporary cash assistance and services
15 pursuant to this chapter provided to a person in this state
16 shall be terminated immediately when that person becomes an
17 inmate in any prison or other correctional institution.
18 Section 3. Subsection (6) is added to section 414.32,
19 Florida Statutes, to read:
20 414.32 Prohibitions and restrictions with respect to
21 food stamps.--
22 (6) TERMINATION OF FOOD STAMP BENEFITS TO
23 INMATES.--All food stamp benefits provided to a person shall
24 be terminated immediately when that person becomes an inmate
25 in any prison or other correctional institution.
26 Section 4. Subsection (9) is added to section 409.903,
27 Florida Statutes, to read:
28 409.903 Mandatory payments for eligible persons.--The
29 department shall make payments for medical assistance and
30 related services on behalf of the following persons who the
31 department determines to be eligible, subject to the income,

1 assets, and categorical eligibility tests set forth in federal
2 and state law. Payment on behalf of these Medicaid eligible
3 persons is subject to the availability of moneys and any
4 limitations established by the General Appropriations Act or
5 chapter 216.
6 (9) All medicaid services provided to an eligible
7 person pursuant to this section shall be terminated
8 immediately when that person becomes an inmate in any prison
9 or other correctional institution.
10 Section 5. Subsection (6) is added to section 409.904,
11 Florida Statutes, to read:
12 409.904 Optional payments for eligible persons.--The
13 agency may make payments for medical assistance and related
14 services on behalf of the following persons who are determined
15 to be eligible subject to the income, assets, and categorical
16 eligibility tests set forth in federal and state law. Payment
17 on behalf of these Medicaid eligible persons is subject to the
18 availability of moneys and any limitations established by the
19 General Appropriations Act or chapter 216.
20 (6) All medical assistance and related services
21 provided to an eligible person pursuant to this section shall
22 be terminated immediately when that person becomes an inmate
23 in any prison or other correctional institution.
24 Section 6. This act shall take effect upon becoming a
25 law.
