  1                      A bill to be entitled

  2         An act relating to emergency medical

  3         transportation services; amending s. 401.25,

  4         F.S.; providing that certain municipalities may

  5         issue the certificate of public convenience and

  6         necessity required for licensure as a basic or

  7         advanced life support service; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Paragraph (d) of subsection (2) and

13  subsection (6) of section 401.25, Florida Statutes, are

14  amended to read:

15         401.25  Licensure as a basic life support or an

16  advanced life support service.--

17         (2)  The department shall issue a license for operation

18  to any applicant who complies with the following requirements:

19         (d)  The applicant has obtained a certificate of public

20  convenience and necessity from each county in which the

21  applicant will operate or, if the applicant will operate in a

22  municipality with a population greater than 30,000, from that

23  municipality.  In issuing the certificate of public

24  convenience and necessity, the governing body of each county

25  shall consider the recommendations of municipalities within

26  its jurisdiction, and the governing body of a municipality

27  shall consider the recommendations of appropriate agencies

28  under its jurisdiction.

29         (6)  The governing body of each county, and each

30  municipality with a population greater than 30,000, may adopt

31  ordinances that provide reasonable standards for certificates

  1  of public convenience and necessity for basic or advanced life

  2  support services and air ambulance services.  In developing

  3  standards for certificates of public convenience and

  4  necessity, the governing body of the each county or

  5  municipality must consider state guidelines and,

  6  recommendations of the local or regional trauma agency created

  7  under chapter 395, the governing body of a county must

  8  consider and the recommendations of municipalities within its

  9  jurisdiction, and the governing body of a municipality must

10  consider the recommendations of appropriate agencies under its

11  jurisdiction.

12         Section 2.  This act shall take effect upon becoming a

13  law.
