14         On page 1, line 30, through

15            page 2, line 8, delete those lines

17  and insert:

18         (2)  A professional journalist has a qualified

19  privilege not to be a witness concerning, and not to disclose

20  the information, including the identity of any source, that

21  the professional journalist has obtained while actively

22  gathering news. This observations obtained within the normal

23  scope of employment and shall not apply to physical evidence,

24  eyewitness observations, or visual or audio recordings of

25  crimes. A party seeking to overcome this privilege
