14         On page 1, line 30 through page 2, line 8, delete those

15  lines

17  and insert:

18         (2) A professional journalist has a qualified privilege

19  not to be a witness concerning, and not to disclose the

20  information, including the identity of any source, that the

21  professional journalist has obtained while actively gathering

22  news. This privilege applies only to information or eyewitness

23  observations obtained within the normal scope of employment

24  and does not apply to physical evidence, eyewitness

25  observations, or visual or audio recording of crimes. A party

26  seeking to overcome this privilege
