  1                      A bill to be entitled

  2         An act relating to passengers of vehicles;

  3         amending s. 316.2015, F.S.; prohibiting persons

  4         from riding on the exterior of a passenger

  5         vehicle or the bed of a pickup truck or flatbed

  6         truck; providing penalties; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 316.2015, Florida Statutes, is

12  amended to read:

13         316.2015  Unlawful for person to ride on exterior of

14  vehicle.--

15         (1)  It is unlawful for any operator of a passenger

16  vehicle to permit any person to ride on the bumper, radiator,

17  fender, hood, top, trunk, or running board of such vehicle

18  when operated upon any street or highway which is maintained

19  by the state, county or municipality.  However, the operator

20  of any vehicle shall not be in violation of this section when

21  such operator permits any person to occupy seats securely

22  affixed to the exterior of such vehicle. Any person who

23  violates the provisions of this subsection shall be cited for

24  a moving violation, punishable as provided in chapter 318.

25         (2)  No person shall ride on any vehicle upon any

26  portion thereof not designed or intended for the use of

27  passengers, including the bed of a pickup truck or flatbed

28  truck. This provision shall not apply to an employee engaged

29  in the necessary discharge of a duty or to a person or persons

30  riding within truck bodies in space intended for merchandise.

31  Any person who violates the provisions of this subsection

  1  shall be cited for a nonmoving violation, punishable as

  2  provided in chapter 318.

  3         (3)  This section shall not apply to a performer

  4  engaged in a professional exhibition or person participating

  5  in an exhibition or parade, or any such person preparing to

  6  participate in such exhibitions or parades.

  7         Section 2.  This act shall take effect October 1, 1998.

10                          SENATE SUMMARY

11    Specifies the beds of pickup trucks and the beds of
      flatbed trucks as areas on which it is unlawful for
12    persons to ride. Provides that it is unlawful for the
      operator of a passenger vehicle to permit another to ride
13    on the bumper, radiator, fender, hood, top, trunk, or
      running board of the vehicle, whether or not in a
14    securely affixed seat.
