3 amending s. 381.0062, F.S.; revising conditions
4 for an exemption from permitting requirements
5 for certain establishments with limited-use
6 commercial public water systems; requiring
7 one-time registration; requiring posting of
8 certain notices; providing an exemption from
9 permitting requirements for the owner of a
10 duplex, triplex, or quadruplex; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Paragraph (b) of subsection (6) of section
16 381.0062, Florida Statutes, 1996 Supplement, is amended, and
17 paragraph (c) is added to said subsection, to read:
18 381.0062 Supervision; private and certain public water
19 systems.--
20 (6) VARIANCES AND EXEMPTIONS.--
21 (b) Any establishment with a limited-use commercial
22 public water system which does not make tap water available
23 for public consumption and which provides bottled water for
24 consumption by its employees is exempt from this section if
25 the system is registered with the department and a notice is
26 posted at each water outlet that the water is not approved for
27 human consumption. Registration is required only once for
28 each exempt system and must be in a manner prescribed by the
29 department. meets the water quality standards established by

1 operating permit from the department, provided the supplier of
2 water:
3 1. Registers with the department;
4 2. Performs an initial water quality clearance of the
5 water supply well; and
6 3. Conducts annual testing for bacteria in the form of
7 one satisfactory microbiological sample per calendar year. In
8 the event that the establishment changes ownership or business
9 activity, reregistration is required. A fee of $15 shall be
10 assessed for registration.
11 (c) Any owner of a duplex, triplex, or quadruplex is
12 exempt from obtaining an annual operating permit from the
13 department.
14 Section 2. This act shall take effect July 1, 1997.

Eliminates current conditions for exempting a limited-use
19 public water system that does not make tap water
available to the public from Department of Health
20 permitting requirements. Exempts such systems if they
provide bottled water for their employees, post
21 nonpotability notices on their water outlets, and pay a
one-time registration fee to the department. Also exempts
22 any owner of a duplex, triplex, or quadruplex from the
department's water system permitting requirements.
