  1                      A bill to be entitled

  2         An act relating to state employment; amending

  3         s. 110.205, F.S.; adding employees in the

  4         managerial/confidential and supervisory

  5         bargaining units organized under ch. 447, F.S.,

  6         to those employees exempted from the Career

  7         Service System; requiring the Legislature to

  8         evaluate the relevance and appropriateness of

  9         personnel protections for career service

10         employees; repealing part II of ch. 110, F.S.,

11         relating to the career service system;

12         providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  Paragraph (v) is added to subsection (2) of

17  section 110.205, Florida Statutes, to read:

18         110.205  Career service; exemptions.--

19         (2)  EXEMPT POSITIONS.--The exempt positions which are

20  not covered by this part include the following, provided that

21  no position, except for positions established for a limited

22  period of time pursuant to paragraph (h), shall be exempted if

23  the position reports to a position in the career service:

24         (v)  All state employees in the managerial/confidential

25  and supervisory bargaining units organized under chapter 447.

26         Section 2.  The Legislature shall evaluate the

27  relevance and appropriateness of personnel protections

28  afforded employees in the career service system using the

29  following criteria:

  1         (1)  The extent to which supervisory training systems

  2  encourage and motivate employees to perform at their highest

  3  and best levels;

  4         (2)  Whether the insulation of public employees from

  5  normal market forces complements or restricts state agency

  6  ability to achieve statutory missions;

  7         (3)  Whether current recruitment, retention, and

  8  promotion systems achieve their stated objectives in a timely

  9  and effective manner;

10         (4)  Whether alternative contractual or

11  performance-based employment systems can be linked to the

12  achievement of employer performance objectives;

13         (5)  Whether compensation systems fairly represent the

14  nature of the changing salary and benefit marketplace.

15         Section 3.  Part II of chapter 110, Florida Statutes,

16  consisting of sections 110.201, 110.203, 110.205, 110.207,

17  110.209, 110.21, 110.211, 110.213, 110.2135, 110.215, 110.217,

18  110.219, 110.221, 110.227, 110.233, and 110.235, is repealed

19  July 1, 2000.

20         Section 4.  This act shall take effect July 1, 1998.

23                          SENATE SUMMARY

24    Adds employees in the managerial/confidential and
      supervisory bargaining units organized under ch. 447,
25    F.S., to the employees exempt from the Career Service
      System. Requires the Legislature to evaluate the
26    relevance and appropriateness of personnel protections
      for career service employees. Repeals part II of ch. 110,
27    F.S., relating to the Career Service System, effective
      July 1, 2000.
