2 An act relating to education funding; amending
3 s. 24.121, F.S.; stating legislative intent
4 with respect to the use of lottery moneys from
5 the Educational Enhancement Trust Fund;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (5) of section 24.121, Florida
11 Statutes, 1996 Supplement, is amended to read:
12 24.121 Allocation of revenues and expenditure of funds
13 for public education.--
14 (5)(a) Public educational programs and purposes funded
15 by the Educational Enhancement Trust Fund may include, but are
16 not limited to, endowment, scholarship, matching funds, direct
17 grants, research and economic development related to
18 education, salary enhancement, contracts with independent
19 institutions to conduct programs consistent with the state
20 master plan for postsecondary education, or any other
21 educational program or purpose deemed desirable by the
22 Legislature. The Legislature may not substitute funds from the
23 Educational Enhancement Trust Fund for funds provided in the
24 annual General Appropriations Act. Funds from the trust fund
25 may be used only to enhance public education programs and
26 purposes and not to underwrite the basic programs and purposes
27 of public education in this state.
28 (b) Except as provided in paragraphs (c) and (d), the
29 Legislature shall equitably apportion moneys in the trust fund
30 among public schools, community colleges, and universities.

1 (c) A portion of such net revenues, as determined
2 annually by the Legislature, shall be distributed to each
3 school district and shall be made available to each public
4 school in the district for enhancing school performance
5 through development and implementation of a school improvement
6 plan pursuant to s. 230.23(18).
7 (d) Beginning July 1, 1993, no funds shall be released
8 for any purpose from the Educational Enhancement Trust Fund to
9 any school district in which one or more schools do not have
10 an approved school improvement plan pursuant to s. 230.23(18).
11 (e) Each school district shall, on a quarterly basis,
12 make available to the public and distribute, in an easy to
13 understand format, the expenditures of lottery funds allocated
14 to the school district.
15 Section 2. This act shall take effect upon becoming a
16 law.

19 SENATE SUMMARY
20 Declares legislative intent with respect to the use of
lottery moneys in the Educational Enhancement Trust Fund;
21 such moneys are an enhancement to, and not a substitute
for, basic educational funding, which is to be provided
22 through the General Appropriations Act.
