4 Turtle license plate; providing for the
5 distribution of annual use fees received from
6 the sale of such plates; providing a contingent
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Paragraph (s) is added to subsection (4) of
12 section 320.08056, Florida Statutes, to read:
13 320.08056 Specialty license plates.--
14 (4) The following license plate annual use fees shall
15 be collected for the appropriate specialty license plates:
16 (s) Sea Turtle license plate, $17.50.
17 Section 2. Subsection (19) is added to section
18 320.08058, Florida Statutes, to read:
19 320.08058 Specialty license plates.--
20 (19) SEA TURTLE LICENSE PLATES.--
21 (a) The department shall develop a Sea Turtle license
22 plate as provided in this section. The word "Florida" must
23 appear at the top of the plate, the words "Helping Sea Turtles
24 Survive" must appear at the bottom of the plate, and the image
25 of a sea turtle must appear in the center of the plate.
26 (b)1. The annual use fees shall be deposited in the
27 Marine Resources Conservation Trust Fund in the Florida
28 Department of Environmental Protection. The first $500,000 in
29 annual revenue shall be used by the Florida Marine Turtle
30 Protection Program to conduct sea turtle protection, research,
31 and recovery programs. Additional license plate revenue, up to

1 an amount not exceeding 30 percent of the total annual
2 revenue, shall be dispersed annually through the marine turtle
3 grants program as created herein. The remaining annual revenue
4 shall be used by the Florida Marine Turtle Protection Program
5 for sea turtle conservation activities.
6 2. There is established within the Department of
7 Environmental Protection a marine turtle grants program. The
8 department shall provide grants to coastal local governments,
9 educational institutions, or Florida-based nonprofit
10 organizations to conduct marine turtle research, conservation,
11 or educational activities within the state. The department
12 shall adopt by rule procedures for submitting grant
13 applications and criteria for allocating available funds. The
14 criteria must include the scope of the proposed activity, the
15 relevance of the proposed activity to the recovery plans for
16 marine turtles, the demand and public support for the proposed
17 activity, the duration of the proposed activity, the
18 availability of alternative funding, and the estimated cost of
19 the activity. The Secretary of Environmental Protection shall
20 appoint a committee of at least five members, including at
21 least two nongovernmental representatives, to consider and
22 choose grant recipients from proposals submitted by eligible
23 entities. Committee members shall not receive any compensation
24 from the department.
25 Section 3. This act shall take effect July 1, 1997,
26 but it shall not take effect unless it is enacted by at least
27 a three-fifths vote of the membership of each house of the
28 Legislature.
