Florida House of Representatives - 1997 CS/HB 1557 By the Committee on Transportation and Representatives Horan, Murman, Brown and Heyman 1 A bill to be entitled 2 An act relating to specialty license plates; 3 amending s. 320.08056, F.S.; providing for a 4 Sea Turtle and an Adopt Greyhounds license 5 plate; providing for an annual use fee; 6 amending s. 320.08058, F.S.; providing for the 7 distribution and use of the annual use fee; 8 amending s. 370.12, F.S.; creating a marine 9 turtle grants program within the Department of 10 Environmental Protection; providing an 11 effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Paragraphs (s) and (t) are added to 16 subsection (4) of section 320.08056, Florida Statutes, 1996 17 Supplement, to read: 18 320.08056 Specialty license plates.-- 19 (4) The following license plate annual use fees shall 20 be collected for the appropriate specialty license plates: 21 (s) Sea Turtle license plate, $17.50. 22 (t) Adopt Greyhounds license plate, $20. 23 Section 2. Subsections (19) and (20) are added to 24 section 320.08058, Florida Statutes, 1996 Supplement, to read: 25 320.08058 Specialty license plates.-- 26 (19) SEA TURTLE LICENSE PLATE.-- 27 (a) The department shall develop a Sea Turtle license 28 plate as provided in this section. The word "Florida" must 29 appear at the top of the plate, the words "Helping Sea Turtles 30 Survive" must appear at the bottom of the plate, and the image 31 of a sea turtle must appear in the center of the plate. 1 CODING: Words stricken are deletions; words underlined are additions. The annual use fee proceeds shall be deposited 2 in the Marine Resources Conservation Trust Fund in the 3 Department of Environmental Protection. 4 2. The first $500,000 in annual use fee proceeds shall 5 be used by the Florida Marine Turtle Protection Program to 6 conduct sea turtle protection, research, and recovery 7 programs. 8 3. The remaining annual use fee proceeds shall be used 9 by the Department of Environmental Protection for sea turtle 10 conservation activities, except up to 30 percent of the 11 remaining annual use fee proceeds shall be annually disbursed 12 through the marine turtle grants program as provided in s. 13 370.12(1)(h). 14 (20) ADOPT GREYHOUNDS LICENSE PLATES.-- 15 (a) The department shall develop an Adopt Greyhounds 16 license plate as provided in this section. The word "Florida" 17 must appear at the top of the plate, and the words "Adopt 18 Greyhounds" must appear at the bottom of the plate. 19 (b) The annual use fee proceeds shall be distributed 20 in equal amounts to the American Greyhound Council to provide 21 funds for food and shelter for greyhounds who have raced and 22 retired in this state, to the Friends of Greyhounds to support 23 adoption awareness programs and advertising campaigns, and to 24 the Florida Greyhound Association to develop and fund an 25 annual Florida Bred Breeder's Cup. 26 Section 3. Paragraph (h) is added to subsection (1) of 27 section 370.12, Florida Statutes, 1996 Supplement, to read: 28 370.12 Marine animals; regulation.-- 29 (1) PROTECTION OF MARINE TURTLES.-- 30 (h) The department shall provide grants to coastal 31 local governments, education institutions, and Florida-based 2 CODING: Words stricken are deletions; words underlined are additions. The 3 department shall adopt by rule procedures for submitting grant 4 applications and criteria for allocating available funds. The 5 criteria must include the scope of the proposed activity, the 6 relevance of the proposed activity to the recovery plans for 7 marine turtles, the demand and public support for the proposed 8 activity, the duration of the proposed activity, the 9 availability of alternative funding, and the estimated cost of 10 the activity. The secretary of the department shall appoint a 11 committee of at least five members, including at least two 12 nongovernmental representatives, to consider and choose grant 13 recipients from proposals submitted by eligible entities. 14 Committee members shall not receive any compensation from the 15 department. 16 Section 4.
