Florida House of Representatives - 1997 HB 1567 By Representative Effman 1 A bill to be entitled 2 An act relating to used watches; amending s. 3 501.925, F.S.; redefining what constitutes a 4 used watch, for purposes of the regulation of 5 their sale; providing an effective date. 6 7 Be It Enacted by the Legislature of the State of Florida: 8 9 Section 1. Subsection (5) of section 501.925, Florida 10 Statutes, is amended to read: 11 501.925 Used watches; sales regulated.-- 12 (5) A watch shall be deemed to be used if: 13 (a) It as a whole or the case thereof or the movement 14 thereof has been previously sold to or acquired by any person 15 who bought or acquired the same for his use or the use of 16 another, but not for resale; provided, however, that a watch 17 that which has been so sold or acquired and is thereafter 18 returned either through an exchange or for credit to the 19 original individual, firm, partnership, association or 20 corporation who sold or passed title to such watch within 10 21 days after the sale or acquisition thereof, shall not be 22 deemed to be a used watch for the purpose of this section, if 23 such vendor keeps shall keep a written or printed record 24 setting forth the name of the purchaser thereof, the date of 25 the sale or transfer thereof and the serial number, if any, on 26 the case and the movement, and any other distinguishing 27 numbers or identification marks, which said record must shall 28 be kept for at least 2 years from the date of such sale or 29 transfer and shall be open for inspection during all business 30 hours by the sheriff or any prosecuting officer of the county 31 in which such vendor is engaged in business; or 1 CODING: Words stricken are deletions; words underlined are additions. Florida House of Representatives - 1997 HB 1567 579-109-97 1 (b) Its case serial numbers or movement numbers or 2 other distinguishing numbers or identification marks are shall 3 be erased, defaced, removed, altered or covered; however, a 4 watch will not be deemed used if such numbers or marks are 5 erased, defaced, removed, altered, or covered by any person, 6 firm, partnership, association, or corporation engaged in the 7 business of selling watches who bought or acquired such watch 8 for resale, but not for his use or the use of another, from an 9 authorized dealer who bought or acquired such watch directly 10 from its manufacturer, wholesaler, or distributor; or 11 (c) Its movement is more than 5 years old and has been 12 repaired by any person or persons, including the vendor. 13 Cleaning and oiling a watch movement or recasing the movement 14 in a new case shall not be deemed a watch repair for the 15 purpose of this section. 16 Section 2. This act shall take effect July 1, 1997. 17 18 ***************************************** 19 SENATE SUMMARY 20 Provides that a watch that has had identifying numbers or marks erased, removed, or otherwise obliterated will not 21 be deemed a used watch if such acts were performed by a person who acquired the watch for resale, and not for his 22 own use or for the use of another, from a dealer that, in turn, acquired the watch from its manufacturer, 23 wholesaler, or distributor. 24 25 26 27 28 29 30 31 2
