  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Administration Trust Fund within the Department

  4         of Highway Safety; providing for sources of

  5         moneys and purposes; providing for future

  6         review and termination or re-creation of the

  7         trust fund; providing a contingent effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  The Administration Trust Fund is hereby

13  created, to be administered by the Department of Highway

14  Safety.  Funds shall be credited to the trust fund as provided

15  in CS/HB 223 or similar legislation, to be used for the

16  purposes set forth therein.

17         Section 2.  (1)  Pursuant to the provisions of Section

18  19(f)(2), Article III of the State Constitution, the

19  Administration Trust Fund shall, unless terminated sooner, be

20  terminated on July 1, 2001.

21         (2)  Prior to the regular legislative session

22  immediately preceding the date on which the trust fund is

23  scheduled to be terminated, the Department of Highway Safety

24  and the Governor shall recommend to the President of the

25  Senate and the Speaker of the House of Representatives whether

26  the trust fund should be allowed to terminate or should be

27  re-created.  These recommendations shall be based on a review

28  of the purpose and use of the trust fund and a determination

29  of whether the trust fund will continue to be necessary.  A

30  recommendation to re-create the trust fund may include

31  suggested modifications to the purposes, sources of receipts,

  1  and allowable expenditures for the trust fund.  The Department

  2  of Highway Safety's recommendation shall be made as a part of

  3  its legislative budget request to the Legislature pursuant to

  4  section 216.023, Florida Statutes.  The Governor's

  5  recommendation shall be made as a part of the recommended

  6  budget presented to the Legislature pursuant to section

  7  216.162, Florida Statutes.

  8         (3)  If the trust fund is terminated, the Department of

  9  Highway Safety shall pay any outstanding debts or obligations

10  of the trust fund as soon as practicable and the Comptroller

11  shall close out and remove the trust fund from the various

12  state accounting systems, using generally accepted accounting

13  practices concerning warrants outstanding, assets, and

14  liabilities.

15         Section 3.  This act shall take effect July 1, 1997, if

16  CS/HB 223 or similar legislation is adopted in the same

17  legislative session or an extension thereof.
