1 A bill to be entitled
2 An act relating to deceptive and unfair trade
3 practices; creating s. 501.2076, F.S.;
4 specifying as an unfair, deceptive, and
5 unconscionable trade practice the use of
6 data-processing software that determines
7 credit-worthiness based solely upon place of
8 residence and that results in unlawful
9 discrimination; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 501.2076, Florida Statutes, is
14 created to read:
15 501.2076 Use of software to determine
16 credit-worthiness; discriminatory impact.--It is an unfair,
17 deceptive, and unconscionable trade practice for any financial
18 institution, subsidiary of a financial institution, service
19 corporation, or party affiliated with a financial institution,
20 doing business in this state, to use data-processing software,
21 as defined in s. 282.303(8), that determines the
22 credit-worthiness of a person based solely upon his or her
23 place of residence and the use of which has as a direct or
24 consequential result an unlawful discriminatory effect upon a
25 loan applicant.
26 Section 2. This act shall take effect upon becoming a
27 law.
