11  Senator Dudley moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 31, before line 1,

16  insert:

17         Section 15.  Subsection (1) of section 721.97, Florida

18  Statutes, as created by CS for CS for SB 626 (1998) is amended

19  to read:

20         (1)  The Governor may appoint commissioners of deeds to

21  take acknowledgments, proofs of execution, or oaths in any

22  foreign country. The term of office is 4 years. Commissioners

23  of deeds shall have authority to take acknowledgments, proofs

24  of execution, and oaths in connection with the execution of

25  any deed, mortgage, deed of trust, contract, power of

26  attorney, or any other writing to be used or recorded in

27  connection with a timeshare estate, timeshare license, any

28  property subject to a timeshare plan, or the operation of a

29  timeshare plan located within this state; provided such

30  instrument or writing is executed outside the United States.

31  Such acknowledgments, proofs of execution, and oaths must be

 1  taken or made in the manner directed by the laws of this

 2  state, including but not limited to s. 117.05(4), (5)(a) and

 3  (6), Florida Statutes (1997) and certified by a commissioner

 4  of deeds. The certification must be endorsed on or annexed to

 5  the instrument or writing aforesaid and has the same effect as

 6  if made or taken by a notary public licensed in this state.

 7         Section 16.  The amendment to section 721.97(1),

 8  Florida Statutes, made by section 18 of this act shall take

 9  effect only if CS for HB 1125 (1998) becomes law, and shall

10  operate retroactively to the effective date of CS for CS for

11  SB 626 (1998).
