2 An act relating to Challenger license plates;
3 amending s. 320.08058, F.S.; revising language
4 with respect to the distribution of the
5 Challenger license plate funds; providing for
6 the use of such funds; providing for the
7 expiration of authority for issuance of such
8 license plates; amending s. 320.08056, F.S.;
9 authorizing a reduction in the annual use fee
10 for bulk purchasers of such license plates;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:
14
15 Section 1. Subsection (2) of section 320.08058,
16 Florida Statutes, 1996 Supplement, is amended to read:
17 320.08058 Specialty license plates.--
18 (2) CHALLENGER LICENSE PLATES.--
19 (a) The department shall develop a Challenger license
20 plate to commemorate the seven astronauts who died when the
21 space shuttle Challenger exploded on liftoff in 1986. The word
22 "Florida" shall appear at the top of the plate, and the word
23 "Challenger" must appear at the bottom of the plate, both
24 words in small letters.
25 (b)1.
26 a. Fifty percent of the Challenger license plate
27 annual use fee must be distributed to the Astronauts Memorial
28 Foundation, Inc., to support the operations of deposited into
29 the Center for Space Education and the Education Technology
30 Institute. Funds received by the Astronauts Memorial
31 Foundation, Inc., may be used for administrative costs

1 directly associated with the operation of the center and the
2 institute. Trust Fund within the Department of Education.
3 These funds must be used solely for the design, construction,
4 maintenance, and support of the operations of the Center for
5 Space Education and the Education Technology Institute
6 operated by the Astronauts Memorial Foundation, Inc. These
7 operations must include preservice and inservice training in
8 the use of technology for the state's instructional personnel
9 in a manner consistent with state training programs and
10 approved by the Department of Education. Up to 20 percent of
11 funds received by the Center for Space Education and the
12 Education Technology Institute from the Center for Space
13 Education Trust Fund may be expended for administrative costs
14 directly associated with the operation of the center and the
15 institute.
16 b. Upon approval of the Department of Education, funds
17 must be transferred from the Center for Space Education Trust
18 Fund to the Astronauts Memorial Foundation, Inc., solely to
19 design, construct, maintain, and support the operations of the
20 Center for Space Education and the Education Technology
21 Institute. A request for the transfer of funds must include
22 information relating to specific plans for disbursing the
23 funds. Before expending funds from their account, the
24 Astronauts Memorial Foundation, Inc., must request approval
25 from the Department of Education, as if the funds were in the
26 Department of Education's trust fund.
27 2. Subparagraph 1. is repealed July 1, 1997. After
28 the date of repeal, the funds distributed pursuant to
29 subparagraph 1. shall be distributed to the Challenger
30 Astronauts Memorial Undergraduate Scholarship Trust Fund
31 created in s. 240.408.

1 3. Twenty-five percent of the Challenger license plate
2 annual use fee must be distributed to the Challenger
3 Astronauts Memorial Undergraduate Scholarship Trust Fund, for
4 use as provided by s. 240.408.
5 (c) Fifty 4. The remaining 25 percent must be
6 distributed to the Technological Research and Development
7 Authority created by s. 2, chapter 87-455, Laws of Florida,
8 for the purpose of funding space-related space research
9 grants, the Teacher/Quest Scholarship Program under s.
10 240.4082 as approved by the Florida Department of Education,
11 and space-related economic development programs. The
12 Technological Research and Development Authority shall
13 coordinate and distribute available resources among state
14 universities and independent colleges and universities based
15 on the research strengths of such institutions in space
16 science technology, community colleges, public school
17 districts, and not-for-profit educational organizations.
18 (d) Up to 10 percent of the funds distributed under
19 paragraphs (b) and (c) may be used for continuing promotion
20 and marketing of the license plate.
21 (e)5. The Auditor General has the authority to examine
22 any and all records pertaining to the Astronauts Memorial
23 Foundation, Inc., and the Technological Research and
24 Development Authority to determine compliance with the law.
25 (f) This subsection expires July 1, 2001.
26 Section 2. Paragraph (b) of subsection (4) of section
27 320.08056, Florida Statutes, 1996 Supplement, is amended to
28 read:
29 320.08056 Specialty license plates.--
30 (4) The following license plate annual use fees shall
31 be collected for the appropriate specialty license plates:

1 (b) Challenger license plate, $15, except that a
2 person that purchases 1,000 or more Challenger license plates
3 shall pay an annual use fee of $10 per plate.
4 Section 3. This act shall take effect July 1, 1997.
