  1                      A bill to be entitled

  2         An act relating to water and wastewater

  3         utilities; amending s. 367.081, F.S.; requiring

  4         the Public Service Commission to extend time

  5         periods and reschedule events by the number of

  6         days a utility is late in providing discovery;

  7         providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Subsection (9) is added to section 367.081,

12  Florida Statutes, to read:

13         367.081  Rates; procedure for fixing and changing.--

14         (9)  If a utility fails to comply fully with valid

15  requests for discovery by the due date for the discovery, the

16  commission shall extend all time periods otherwise provided in

17  this section by the same number of days by which the discovery

18  was provided late, and the commission shall similarly

19  reschedule all events recognized by the commission by the

20  number of days by which the discovery was provided late,

21  including, but not limited to, prehearing conferences,

22  deadlines for filing testimony, hearing dates, discovery due

23  dates, and the periods for withholding consent to rate

24  requests.

25         Section 2.  This act shall take effect upon becoming a

26  law.
