11  The Committee on Civil Justice & Claims offered the following:

13         Amendment 

14         On page 2, line(s) 16, of the bill

16  insert:    (Substantial rewarding of Subsection (2).  See s.

17  627.7263, F.S., for present text.)

18         Section 2.  Subsection (2) of section 627.7263, F. S.,

19  is amended to read:

20         627.7263 Rental and leasing driver's insurance to be

21  primary; exception.--

22         (2)  If the lessee's coverage is to be primary, the

23  rental or lease agreement must contain the following language,

24  in at lease 10-point type:

25         "Your own valid and collectible motor vehicle liability

26  insurance and personal injury protection insurance is primary

27  for the limits of liability and personal injury protection

28  coverage required by ss. 324.021(7) and 627.736, F.S.

29         In no event will the (name) motor vehicle rental

30  business be obligated to defend and/or indemnify you cause an

31  accident.

  1         Further, if you cause an accident which damages the

  2  property/injures other(s) resulting in damages in an amount in

  3  excess of your own insurance coverage limits, you may be held

  4  liable to (name) the motor vehicle rental business for any

  5  sums it is caused to expend for damages, costs, and attorneys

  6  fees as a result of you having caused an accident."
