18 (a) Shall not be liable to any occupant 21 years of
19 age or older of a rental vehicle for the actions of a person
20 operating the rental vehicle without a showing of negligence
21 or intentional misconduct on the part of the motor vehicle
22 rental business or its employees, except when the person
23 operating the vehicle fails to maintain valid and collectable
24 liability insurance in an amount not less than $100,000 per
25 person and $300,000 per incident for bodily injury and $50,000
26 for property damage, in which case the vehicle rental business
27 shall be liable only up to $100,000 per person and up to
28 $300,000 per incident for non-economic damages, and $50,000
29 for property damage, without a showing of negligence or
30 intentional misconduct on the part of the motor vehicle rental
31 business or its employees.

1 (b) Shall be liable to other persons for the actions
2 of an authorized driver operating the rental vehicle, only up
3 to $100,000 per person and up to $300,000 per incident for
4 non-economic damages, and $50,000 for property damage, without
5 a showing of negligence or intentional misconduct on the part
6 of the motor vehicle rental business or its employees. Any
7 primary coverage in effect pursuant to s. 627.7263 may be
8 deducted from these limits in the payment of any claims under
9 this subsection.
10 (c) Shall not be liable to other persons for actions
11 of an unauthorized driver operating the rental vehicle fails
12 to maintain valid and collectable liability insurance in an
13 amount not less than $100,000 per person and $300,000 per
14 incident for bodily injury and $50,000 for property damage, in
15 which case the vehicle rental business shall be liable only up
16 to $100,000 per person and up to $300,000 per incident for
17 non-economic damages, and $50,000 for property damage, without
18 a showing of negligence or intentional misconduct on the part
19 of the motor vehicle rental business or its employees.
