  1                      A bill to be entitled

  2         An act relating to the Parole Commission (RAB);

  3         amending s. 947.07, F.S.; providing guidelines

  4         for rulemaking authority; providing an

  5         effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Section 947.07, Florida Statutes, is

10  amended to read:

11         947.07  Rules of the commission; operation and

12  administration, parole, control release, conditional release,

13  conditional medical release, and specified activities relating

14  to programs and regulations.--The commission may adopt rules

15  that relate to:

16         (1)  The statutory programs under the jurisdiction and

17  authority of the commission, including, but not limited to,

18  parole, mutual participation program, control release,

19  conditional release, and conditional medical release.

20         (2)  Authority regarding the following as it relates to

21  the commission's programs:

22         (a)  Definitions;

23         (b)  Eligibility for programs, eligibility criteria and

24  determinations, interview procedures, objective criteria and

25  guidelines, salient-factor scoring;

26         (c)  Parole, mutual participation program, control

27  release and conditional medical release, and determination of

28  release dates;

29         (d)  Commission voting;

30         (e)  Decisions outside matrix time ranges which involve

31  aggravation or mitigation;

  1         (f)  Actions regarding special types of cases;

  2         (g)  Time in custody calculations;

  3         (h)  Administrative review;

  4         (i)  Commission notification;

  5         (j)  Terms and conditions of supervision;

  6         (k)  Arrest, revocation, and recision procedures and

  7  hearings;

  8         (l)  Early termination of supervision;

  9         (m)  Victim participation, input, and information; and

10         (n)  Forms. The commission shall have power to make

11  such rules and regulations as it deems best for its

12  governance, including among other things rules of practice and

13  procedure and rules prescribing qualifications to be possessed

14  by its employees.

15         Section 2.  This act shall take effect upon becoming a

16  law.
