2 An act relating to rulemaking authority of
3 school boards (RAB); amending s. 230.22, F.S.;
4 prescribing the rulemaking authority of school
5 boards; ratifying certain extant rules;
6 providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (2) of section 230.22, Florida
11 Statutes, is amended to read:
12 230.22 General powers of school board.--The school
13 board, after considering recommendations submitted by the
14 superintendent, shall exercise the following general powers:
15 (2) Adopt such rules and regulations to supplement
16 those prescribed by the state board and the commissioner as in
17 its opinion will contribute to the more orderly and efficient
18 operation of the district school system. Specifically, such
19 rules include, but are not limited to, rules for governance
20 and operations, general school administration, fiscal
21 management, support services, facilities management,
22 personnel, instructional programs, student management, charter
23 schools, parent relations, school-community relations, court
24 orders, and federal mandates. When adopting such rules, a
25 school board is considered to be acting pursuant to the
26 authority granted by s. 4(b), Art. IX of the State
27 Constitution and s. 230.23. A school board may adopt such
28 rules as in its opinion will contribute to the more orderly
29 and efficient operation of the district school system,
30 notwithstanding the absence of specific rulemaking authority
31 or any other law to the contrary.

1 Section 2. Any rules adopted by a school board before
2 the effective date of this act which would have been valid had
3 they been adopted on or after the effective date of this act
4 are hereby ratified.
5 Section 3. This act shall take effect July 1, 1998.
