1 A bill to be entitled
2 An act relating to mobile surgical facilities;
3 creating s. 395.0164, F.S.; prescribing the
4 characteristics of such facilities; providing
5 that such facilities that contract with the
6 Department of Corrections are exempt from
7 certain licensing and construction requirements
8 and may serve only inmates; allowing such
9 facilities to provide medical care to the
10 public during state or national emergencies;
11 providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Section 395.0164, Florida Statutes, is
16 created to read:
17 395.0164 Mobile surgical facilities.--
18 (1) A mobile surgical facility is a semitrailer as
19 defined in s. 316.003 in which licensed medical professionals
20 provide surgical procedures. It is not an ambulatory surgical
21 center.
22 (2) A mobile surgical facility that has a contract
23 with the Department of Corrections to provide medical services
24 is exempt from the licensing and construction requirements of
25 chapter 395. A mobile surgical facility that is exempted from
26 regulation under this section may serve only inmates who are
27 subject to oversight by the Department of Corrections.
28 (3) A mobile surgical facility may be used to provide
29 medical care to the public during a state or national
30 emergency, as the term "emergency" is defined in s. 252.34.
31 Section 2. This act shall take effect July 1, 1998.
