2 An act relating to uninsured motorist motor
3 vehicle insurance; amending s. 627.727, F.S.;
4 limiting the amount of damages recoverable in
5 certain actions; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (10) of section 627.727, Florida
10 Statutes, is amended to read:
11 627.727 Motor vehicle insurance; uninsured and
12 underinsured vehicle coverage; insolvent insurer protection.--
13 (10) The damages recoverable from an uninsured
14 motorist carrier in an action brought under s. 624.155 shall
15 include those damages which are the natural, proximate,
16 probable, or direct consequence of the insurer's bad faith the
17 total amount of the claimant's damages, including the amount
18 in excess of the policy limits, any interest on unpaid
19 benefits, reasonable attorney's fees and costs, and any
20 damages caused by a violation of a law of this state. The
21 total amount of the claimant's damages is recoverable whether
22 caused by an insurer or by a third-party tortfeasor.
23 Section 2. This act shall take effect October 1, 1997.
