2 An act relating to disability retirement for
3 deputy sheriffs; providing that specified
4 disabilities suffered by deputy sheriffs are
5 presumed to have been incurred in the line of
6 duty; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Deputy sheriffs; retirement; disability in
11 the line of duty.--Any condition or impairment of health of
12 any deputy sheriff employed in the state which is caused by
13 tuberculosis, hypertension, heart disease, or hardening of the
14 arteries and which results in total or partial disability or
15 death shall be presumed to be accidental and suffered in the
16 line of duty unless the contrary is shown by competent
17 evidence. Any condition or impairment of health caused
18 directly or proximately by exposure, which exposure occurred
19 in the active performance of duty at some definite time or
20 place without willful negligence on the part of the deputy
21 sheriff and resulted in total or partial disability, shall be
22 presumed to be accidental and suffered in the line of duty,
23 provided that such deputy sheriff has successfully passed a
24 physical examination upon entering such service, which
25 physical examination including electrocardiogram failed to
26 reveal any evidence of such condition. Such presumption does
27 not apply to benefits payable under or granted in a policy of
28 life insurance or disability insurance. This section applies
29 to all deputy sheriffs employed in the state with reference to
30 pension and retirement benefits under any retirement system of
31 which deputy sheriffs are members.

1 Section 2. This act shall take effect upon becoming a
2 law.

5 SENATE SUMMARY
6 Provides that health impairments suffered by deputy
sheriffs which are caused by tuberculosis, hypertension,
7 heart disease, or hardening of the arteries and which
result in disability or death will be considered as
8 occurring in the line of duty so long as the deputy
sheriff had a physical examination that failed to
9 disclose any such malady before entering service.
