1 A bill to be entitled
2 An act relating to air carriers; directing the
3 Department of Management Services to evaluate
4 the state contract for air carrier service for
5 state employees, to undertake a pilot program,
6 and to adopt purchasing guidelines; directing
7 the Office of Program Policy Analysis and
8 Government Accountability to review the impact
9 of the pilot program and report to the
10 Legislature; directing Enterprise Florida,
11 Inc., to complete a review of the impact of
12 regional airports on economic development in
13 the state; providing an effective date.

15 WHEREAS, it is in the best interest of Florida to
16 attract and retain quality affordable air carrier service for
17 its citizens, and
18 WHEREAS, dependable and affordable air service is an
19 important factor in stimulating economic development and
20 promoting efficient and accountable government service, and
21 WHEREAS, citizens require affordable and efficient
22 access to state government and elected officials in the state
23 capital to promote an open democracy, and
24 WHEREAS, safe and affordable air travel from the state
25 capital to all parts of Florida is necessary to ensure the
26 continued operation of state programs, and
27 WHEREAS, incentives need to be identified to attract
28 and retain quality air service to the state capital from all
29 major airports in Florida to meet the needs of government and
30 industry, and

1 WHEREAS, the Legislature recognizes the need to provide
2 support to air carriers that provide this valuable service,
3 NOW, THEREFORE,

5 Be It Enacted by the Legislature of the State of Florida:

7 Section 1. State air carrier contract.--Pursuant to
8 section 287.042, Florida Statutes, the Department of
9 Management Services shall analyze and evaluate the state
10 contract for air carrier service for state employees to
11 determine how to improve the quality, availability, and cost
12 of air service to state employees and other citizens. The
13 department shall undertake a pilot program for up to a 3-year
14 period based on this analysis which shall include, but is not
15 limited to, the suspension of any such contract and the
16 provision of any incentives necessary to attract qualified air
17 carriers flying within Florida to and from the state capital.
18 In lieu of the provisions of section 112.061(7)(a)2., Florida
19 Statutes, and notwithstanding section 287.042(2), Florida
20 Statutes, or any law or rule to the contrary, in implementing
21 this pilot program the Department of Management Services, in
22 consultation with the Department of Banking and Finance, shall
23 adopt guidelines for good purchasing practices in acquiring
24 air carrier services to and from the state capital. The Office
25 of Program Policy Analysis and Government Accountability shall
26 review the effects and fiscal impact of the pilot program.
27 The report shall include, but is not limited to, information
28 on and analyses of additional costs incurred and savings
29 realized by state agencies, including per diem, subsistence,
30 productivity and time of the travelers, and cost of airfare.
31 The office shall provide the Legislature with a preliminary

1 report prior to the 1999 Regular Session and annually
2 thereafter prior to each regular session during the existence
3 of the pilot program.
4 Section 2. Review of impact of regional
5 airports.--Enterprise Florida, Inc., is directed to undertake
6 and complete a review on the impact of regional airports on
7 economic development in the state. The review shall contain,
8 but is not limited to, findings on the impact of regional
9 airports on the following: regional and local economies;
10 regional and local economic development efforts; and new and
11 expanding manufacturing facilities.
12 Section 3. This act shall take effect July 1, 1998.

COMMITTEE SUBSTITUTE FOR

17 The committee substitute differs from the original bill in the
following ways:

Deletes the exemption from the states sales tax on all labor
19 charges for the repair and maintenance of aircraft of more
than 15,000 pounds maximum certified takeoff weight, thus
20 maintaining the current exemption for those aircraft of more
than 20,000 pounds maximum takeoff weight;

Deletes the exemption from the states sales tax on replacement
22 engines, parts, and equipment used in the repair or
maintenance of aircraft of more than 15,000 pounds maximum
23 certified takeoff weight;
24 Deletes the provision which allows up to 20 percent of the
assistance provided by the Department of Transportation for
25 each airport's work program budget to improve scheduled
airline service;

Deletes the provision which states that projects that are
27 designed to improve scheduled air service to and from the
state capital to increase access by citizens to state
28 government shall be deemed to be of statewide importance; and
29 Requires the Office of Program Policy Analysis and Government
Accountability to review the effects and fiscal impact of the
30 pilot program while directing Enterprise Florida, Inc., to
complete a review on the impact of regional airports on
31 economic development in the State of Florida.
