  1                      A bill to be entitled

  2         An act relating to air carriers; directing the

  3         Department of Management Services to evaluate

  4         the state contract for air carrier service for

  5         state employees, to undertake a pilot program,

  6         and to adopt purchasing guidelines; directing

  7         the Office of Program Policy Analysis and

  8         Government Accountability to review the impact

  9         of the pilot program and report to the

10         Legislature; authorizing the department to

11         reinstate certain contracts under certain

12         circumstances; directing Enterprise Florida,

13         Inc., to complete a review of the impact of

14         regional airports on economic development in

15         the state; providing an effective date.

17         WHEREAS, it is in the best interest of Florida to

18  attract and retain quality affordable air carrier service for

19  its citizens, and

20         WHEREAS, dependable and affordable air service is an

21  important factor in stimulating economic development and

22  promoting efficient and accountable government service, and

23         WHEREAS, citizens require affordable and efficient

24  access to state government and elected officials in the state

25  capital to promote an open democracy, and

26         WHEREAS, safe and affordable air travel from the state

27  capital to all parts of Florida is necessary to ensure the

28  continued operation of state programs, and

29         WHEREAS, incentives need to be identified to attract

30  and retain quality air service to the state capital from all

  1  major airports in Florida to meet the needs of government and

  2  industry, and

  3         WHEREAS, the Legislature recognizes the need to provide

  4  support to air carriers that provide this valuable service,

  5  NOW, THEREFORE,

  6

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  State air carrier contract.--Pursuant to

10  section 287.042, Florida Statutes, the Department of

11  Management Services shall analyze and evaluate the state

12  contract for air carrier service for state employees to

13  determine how to improve the quality, availability, and cost

14  of air service to state employees and other citizens.  The

15  department shall undertake a pilot program for up to a 3-year

16  period based on this analysis which shall include, but is not

17  limited to, the suspension of any such contract and the

18  provision of any incentives necessary to attract qualified air

19  carriers flying within Florida to and from the state capital.

20  In lieu of the provisions of section 112.061(7)(a)2., Florida

21  Statutes, and notwithstanding section 287.042(2), Florida

22  Statutes, or any law or rule to the contrary, in implementing

23  this pilot program the Department of Management Services, in

24  consultation with the Department of Banking and Finance, shall

25  adopt guidelines for good purchasing practices in acquiring

26  air carrier services to and from the state capital. The Office

27  of Program Policy Analysis and Government Accountability shall

28  review the effects and fiscal impact of the pilot program.

29  The report shall include, but is not limited to, information

30  on and analyses of additional costs incurred and savings

31  realized by state agencies, including per diem, subsistence,

  1  productivity and time of the travelers, and cost of airfare.

  2  If, within 6 months after implementing such pilot program, the

  3  office determines that the travel costs to state government

  4  have increased by at least 20 percent, the department may

  5  reinstate any portion of the state contract. The office shall

  6  provide the Legislature with a preliminary report prior to the

  7  1999 Regular Session and annually thereafter prior to each

  8  regular session during the existence of the pilot program.

  9         Section 2.  Review of impact of regional

10  airports.--Enterprise Florida, Inc., is directed to undertake

11  and complete a review on the impact of regional airports on

12  economic development in the state.  The review shall contain,

13  but is not limited to, findings on the impact of regional

14  airports on the following: regional and local economies;

15  regional and local economic development efforts; and new and

16  expanding manufacturing facilities. A report, including the

17  results of this review, shall be transmitted to the President

18  of the Senate and the Speaker of the House of Representatives

19  no later than February 1, 1999.

20         Section 3.  This act shall take effect July 1, 1998.

25  The Department of Management Services is authorized to
    reinstate the state air carrier contract if, after
26  implementing the pilot program, it is found that travel costs
    to the state have increased by at least 20 percent. The bill
27  also requires that a report including the results of
    Enterprise Florida's review of the impact of regional airports
28  is to be transmitted to the President of the Senate and the
    Speaker of the House no later than February 1, 1999.
